St. Croix Attorney Charged with Embezzlement

St. Croix attorney Maxwell McIntosh was arrested Thursday and charged with embezzlement, the V.I. Police Department reported.

According to the department’s news release, McIntosh also was charged with obtaining money under false pretenses. The charges were taken after clients complained to police. The Insular Investigation division said the attorney used his clients’ money to operate his business and pay personal bills.

According to the affidavit filed by the detective, McIntosh was hired to oversee a family probate case and given a check for about $183,000. The client filed a report with the VIPD when the matter was not concluded in three years and McIntosh said he was unable to complete the probate.

Further investigation into the matter revealed that the check was deposited into a bank account that did not have any funds, according to police.

A second client of McIntosh told police the attorney was hired to sell some family property for around $260,000 but that McIntosh only gave the owners $20,000. The family said they were unable to recover the balance of the sale from McIntosh.

Detectives said the investigation into McIntosh’s bank account reflects that he was using the account in which he was holding clients’ funds to operate his business and pay personal bills.

McIntosh appeared in Superior Court shortly after his arrest and was released on his own recognizance pending further court action.
