East Indian National Sentenced to Four Months Prison Time for Unlawfully Re-entering U.S.

An East Indian National was sentenced for attempting to re-enter the United States with fraudulent identification, United States Attorney Delia L. Smith announced Thursday.

40-year-old Ashokkumar Patel was sentenced to 139 days of incarceration on his conviction of re-entry of a removed alien, followed by one year of supervised release and a special assessment of $100.00, according to the release.

According to court documents, on Nov. 24, 2021, Patel, an illegal alien from India, was intercepted by U.S. Customs and Border Protection at the Henry E. Rohlsen Airport as he attempted to board Spirit Airlines flight #449 to Fort Lauderdale, FL. At inspection, Patel presented a fraudulent Florida driver’s license. Further inspection revealed that on August 17, 2019, Patel was apprehended and detained by Customs and Border Patrol in Tecate, CA. On Nov. 21, 2019, Patel was removed and departed from the United States to India.

The U.S. Customs and Border Protection and Homeland Security Investigations investigated the case and Assistant United States Attorney Daniel H. Huston prosecuted the case.
