CLOSED SEASONS FOR CONCH AND WHELK

Commissioner Dean C. Plaskett Esq., of the Department of Planning and Natural Resources, advises the public that pursuant to Title 12 VIC, Subchapter 316 (b) and (c), and the rules and regulations promulgated thereto, particular emphasis given to Title 12, Chapter 9a VIRR, Subchapter 316-1 "Closed Season" and Sub-part (b).
Title 12 Chapter 9a,
Subchapter 316-1(a): Pursuant to Title 12 VIC Section 316, the "Closed Season for Conch is hereby prescribed to begin July 1st and end September 30th of each successive year.
Title 12 Chapter 9a,
Subchapter 316-5: Pursuant to Title 12 VIC Section 316, the "Closed Season" for Whelk is hereby prescribed to begin April 1st and end September 30th of each successive year.
Title 12 Chapter 9a: No person is permitted to engage in fishing for conch, whelk or to possess any conch, whelk or parts of conch, whelk, except empty shells, during this period, except as provided at Sections 316-9 and 316-10 of these Rules and Regulations.
Title 12 Chapter 9a,
Subchapter 316(b): The transportation and sale of a species of fish which is the subject of a closed season shall be allowed up to the seventh day after the commencement of the closed season in order to permit the liquidation of stock caught before the beginning of such closed season.
Title 12 Chapter 9a,
Subchapter 316(C): The fishing, sale, transportation and utilization of all species not expressly included in the closed seasons established by rules and regulations hereunder shall be permitted at any time throughout the year. The sale and transportation of any species of fish that is included in the closed season is permitted during the closed season if such fish is imported from outside the United States Virgin Islands or caught and stored prior to the closed season.
