unlawful eviction
Aug 4, 2011 - 08:08

We rented an apartment from a lady who owns the home. We lived underneath he
r. We rented the apt. with utilities incl., however there was a clause in the lease we signned that said "uitlities if required of" and than listed the utilities. She than proceeded to charge with any utilities she wanted to. We refused to pay them stating our utilities were included. Long story short she gave us an informal letter to quit because of non-payment of utlities and took us to court. We used our last month rent for July instead of November and moved out. The court found in our favor and dismissed all claims against us. My question is since the eviction was based on non-payment of utilities and the judge found for us that the utilities were included, can we take her to court for an unlawful eviction and if so what monies can we sue her for and do we take her to a small claims court?
